Postdivorce Relocation and Children: A Psycholegal Dilemma

Children of divorce unwittingly find themselves in a precarious position within both the family and legal systems. Enter the subject of relocation and a whole new group of dilemmas emerge. The decision to relocate after a divorce serves to further complicate the postdivorce family structure and may involve significant repercussions for both children and parents. The controversial and ethically challenging issue of relocation also produces numerous legal concerns for family courts across the country. To effectively address these issues, the behavioral science community and the legal system must work in partnership to determine the best interests of the child when granting custodial parents legal permission to relocate with their children. This article will review the state of the law on the issue of relocation, examine current empirical research, and highlight important criterion that the courts can utilize in their decision-making.
